RENTAL CONDITIONS

THESE TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER THAT AFFECTS YOUR RIGHTS TO RESOLVE DISPUTES. PLEASE READ THIS POLICY CAREFULLY.

1.RENT: You rent to us the Vehicle and other property and accessories listed in the Rental Agreement (collectively, the "Truck"). Such Property may include a tow truck, auto carrier, auto transport kit, or other towing equipment provided by us under this Agreement at additional cost. This property is sometimes referred to separately in this Agreement as "Train Equipment." You agree that this lease is a deposit for mutual benefit only. You acknowledge that the Truck is our property, you have no authority to sublease or transfer the Truck and any attempt to do so is void and a breach of this Agreement. You are not an agent, servant or employee of ours, nor are you a driver of the truck for any purpose. The terms "you" and "your" refer to the person signing the Rental Agreement. The terms “we”, “us” and “our” refer to Budget Truck Rental, LLC.

2.AGREEMENT: These Terms and Conditions, the Rental Agreement signed by you, any other supplemental quote forms or brochures attached to or contained in the Rental Agreement, and a Return Record showing the Rental Charges charged together form the Rental Agreement between you and we. This is the entire agreement between us with respect to this rental. 4.PROHIBITED USE OF TRUCKS: Certain uses of the truck and other things that you or an Authorized Additional Driver do or do not violate this Agreement. 5.WHO CAN DRIVE THE TRUCK: You represent that you are a competent driver with a valid license and that your driver's license has not been suspended, revoked or restricted in any way. 10RENTAL RATES AND CHARGES:

11MAINTENANCE AND INSPECTION:You agree to maintain a proper level of oil and coolant in the engine. F.Subject to applicable law, protection under Sections 16A, 16B, 16C or 16D does NOT apply: (i) if the Truck is purchased, used or operated in violation of Section 4; (ii) for loss of or damage to property belonging to you, on the truck or for any reason under your care, custody or control, and (iii) to a tow truck, auto transporter or trailer not rented or coupled by us on the truck .

17INSURED CLIENT COMPANY ACCOUNT INSURED:

A.If you are a business customer, you may choose to purchase liability insurance instead of purchasing our liability insurance and damage waivers. By proceeding as set forth in the rental agreement, you agree to insure the truck under the standard form of public liability insurance which designates Budget Truck Rental, LLC and Budget Rent A Car System, Inc. as additional insured and all risks are covered loss or damage to persons or property arising from the possession, maintenance, use or operation of the truck during the rental, regardless of fault. The limits of this insurance are not less than a combined individual limit of $750,000 for all bodily injury and property damage resulting from one accident, or higher limits as we may require. You agree to provide us with a certificate of insurance showing required coverage and limitations of liability prior to using the truck. You agree that optional SLI is not available to you once you have chosen to purchase your own liability insurance.

B.You agree to indemnify, hold us harmless, and hold us and our insurers harmless from any costs (including attorneys' fees and court costs), damages, and/or liability arising out of your possession, use, or operation of the Truck (i) exceed the liability limits under your liability insurance, (ii) are excluded from coverage under your liability insurance, or (iii) are not covered by your liability insurance.
