RENTAL CONDITIONS
THESE TERMS AND CONDITIONS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER THAT AFFECTS YOUR RIGHTS TO RESOLVE DISPUTES. PLEASE READ THIS POLICY CAREFULLY.
1.RENT: You rent to us the Vehicle and other property and accessories listed in the Rental Agreement (collectively, the "Truck"). Such Property may include a tow truck, auto carrier, auto transport kit, or other towing equipment provided by us under this Agreement at additional cost. This property is sometimes referred to separately in this Agreement as "Train Equipment." You agree that this lease is a deposit for mutual benefit only. You acknowledge that the Truck is our property, you have no authority to sublease or transfer the Truck and any attempt to do so is void and a breach of this Agreement. You are not an agent, servant or employee of ours, nor are you a driver of the truck for any purpose. The terms "you" and "your" refer to the person signing the Rental Agreement. The terms “we”, “us” and “our” refer to Budget Truck Rental, LLC.
2.AGREEMENT: These Terms and Conditions, the Rental Agreement signed by you, any other supplemental quote forms or brochures attached to or contained in the Rental Agreement, and a Return Record showing the Rental Charges charged together form the Rental Agreement between you and we. This is the entire agreement between us with respect to this rental. Any modification to this Agreement or our rights must be in writing and signed by an authorized employee of Budget Truck Rental, LLC. He also agrees that he is not our agent for any purpose. Your copy of this Agreement must be kept in the truck at all times during the rental.By signing the Rental Agreement you agree to all the terms of this Agreement.If any provision of this Agreement is determined by a court of competent jurisdiction to violate applicable law, that provision will not apply to the extent of that decision, but the remainder of this Agreement will remain in effect.
3.CONDITION OF THE TRUCK, WITHOUT WARRANTY: They inspected the truck. It is in good used condition and suitable for your rental purposes. Has no obvious defects unless noted on our Vehicle Damage Inspection Form.YOU AGREE THAT WE DO NOT EXPRESS OR IMPLIED OF ANY MATTER. THIS INCLUDES AMONG OTHERS OWNERSHIP OF TRUCK, CONDITION OR MERCHANTABILITY OR FITNESS OF TRUCK FOR ANY PARTICULAR PURPOSE. EXCEPT OTHERWISE PROVIDED BY LAW, NO LIABILITY TO YOU FOR PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR DAMAGES IN CONNECTION WITH THIS AGREEMENT OR IN CONNECTION WITH THE PROVISION OF THE TRUCK OR YOUR PERFORMANCE OR USE OF THIS RENTAL VEHICLE.
4.PROHIBITED USE OF TRUCKS: Certain uses of the truck and other things that you or an Authorized Additional Driver do or do not violate this Agreement. Violation of this paragraph automatically terminates your rental and excludes any liability protection and any optional services you have agreed to, including, but not limited to, liability protection, additional liability insurance, personal accident insurance, cargo protection, and cargo expansion relief. damages, optional physical damage waiver, LIMITED DAMAGES OR COMMERCIAL DAMAGES. IT ALSO MAKES YOU LIABLE TO US FOR ALL PENALTIES, fines, forfeitures, liens, and storage and replacement costs, including all related legal fees, fees, and costs that we may incur. a) reckless conduct or conduct that can be duly classified as a crime or misdemeanor, including the transport of controlled substances or contraband;
b) Pushing or towing anything other than Budget towing equipment, such as B. using another person's trailer, including your own, or Budget towing equipment on your own vehicle or another person's vehicle;
c) If the truck or any towing equipment is overloaded, i. H. any cargo that causes the truck or tow equipment to exceed the manufacturer's gross weight rating (empty weight of the truck or tow equipment plus the weight of the cargo) truck or tow equipment, nor with loads attached or secured improper form;
d) driven by someone other than yourself or an additional authorized driver;
e) In a race, event or competition, or off a road or paved surface;
f) If you know or should have known that continued operation of the truck could cause damage to the truck or towing equipment;
g) in a manner that encourages vandalism or theft of the truck, such as B. leaving the truck without removing or securing the keys or failing to close and lock all doors and windows;
h) if the truck was acquired based on false or misleading information;
i) while the driver is under the influence of alcohol or a controlled substance;
j) Transport cars, trucks, animals or people in the cargo area of the truck;
k) In areas where there is an unusual risk of damage to the truck, such as B. Strikes, riots or labor or civil violence, or natural disasters such as hurricanes, floods, fires, earthquakes or landslides when such circumstances are reasonably foreseeable;
l) Anywhere outside of the contiguous United States (ie Alaska, Canada or Mexico);
m) storage, treatment, transportation, or disposal of controlled, toxic, or hazardous materials or wastes, such as corrosive, toxic, flammable (such as gasoline, propane, or oil), explosive, propellant, or radioactive materials, and biohazardous materials, such as medical waste;
n) With unsuitable fuel, e.g. B. fuel a diesel truck with gasoline or diesel fuel in a gasoline truck; o inadequate supply of Diesel Emission Fluids ("DEF");
o) failing to promptly report damage to or loss of the truck when it occurs or become aware of it and failing to provide us with a written accident/incident report or fully cooperating with our investigation; or when required by law, you failed to report an accident to the police;
p) intentional or unlawful acts;
q) Filming our trucks or any trademark, service mark, or copyrighted material, including without limitation any logo or character, without the express written consent of Budget Truck Rental, LLC, except to the extent that allowed by law.
5.WHO CAN DRIVE THE TRUCK: You represent that you are a competent driver with a valid license and that your driver's license has not been suspended, revoked or restricted in any way. Near you,fairThe following persons and no others are additional eligible drivers who may drive the truck: a)consumer rentals– People listed on the rental agreement at the start of the rental (spouse and common-law partner are not authorized additional drivers unless they are listed on the rental agreement) for whom you will have to pay an additional fee, b)Commercial BTR/rental without account– Only the person listed as the driver on the rental documents. For an additional fee, the following additional people can drive the truck: your employees, regular colleagues, employers or formal business partners if they are involved in business, with your express permission, c)Commercial Lease/BTR Account – (defined as your existing business account with us) your employees, regular colleagues, employers or formal business partners while conducting business, with express permission, as long as this commercial lease is made through the BTR account. YOU ACKNOWLEDGE THAT ANY DRIVER, INCLUDING BUT NOT LIMITED TO YOU AND ANY ADDITIONAL AUTHORIZED DRIVERS, MUST BE 18 YEARS OF AGE OR OLDER, PROPERLY LICENSED AND QUALIFIED. YOU UNDERSTAND THAT IT IS YOUR SOLE RESPONSIBILITY TO DETERMINE OR OBTAIN THE APPROPRIATE LICENSES, SIGNS AND DOCUMENTATION TO DRIVE THE TRUCK. DRIVERS WITH LOCKOUT (ALCOHOL) RESTRICTIONS MAY NOT RENT OR DRIVE THE TRUCK. There may also be an additional charge per day if you or an additional authorized driver is under the age of 24. Other requirements may apply, as determined by us from time to time.
6.COMBUSTIBLE:RENTAL PRICES DO NOT INCLUDE FUEL TAXES. THE TRUCK IS AVAILABLE WITH A FULL TANK AT THE BEGINNING OF THE RENTAL. YOU UNDERSTAND THAT YOU ARE RESPONSIBLE FOR ALL FUEL DURING THE RENTAL. YOU UNDERSTAND THAT IF THE LOCATION TO WHICH YOU ARE RETURNING THE TRUCK DOES NOT SELL FUEL OR OFFER OPTIONAL FUEL SERVICE, YOU MUST RETURN THE TRUCK WITH A FULL TANK OF FUEL. If the drop-off point sells fuel, you understand that you may fill the tank with fuel yourself at the drop-off point at the then listed fuel price or at a fuel dealer of your choice. If you choose not to fill your tank with fuel prior to return, you agree to pay a service fee in addition to (a) the actual retail cost of fuel to fill the truck (if the location sells fuel) or (b) a competitive price fee payable per gallon of truck fuel (measured from the factory installed fuel gauge in 1/8 increments). You understand that optional fuel or refueling services are not available in all locations and that charges vary by location. Competitive prices per gallon may be higher than retail fuel prices at fuel distributors such as: B. service stations. You agree to contact the delivery location prior to returning the truck to verify availability and rates for fuel or optional refueling service.
7.RETURN OF TRUCKS:You return the truck to us in the same condition in which you rented it, on the date and time specified in the rental agreement. You must return it earlier at our request. If you return it earlier or later, a different or higher fee may apply, and if you return it later, you may be charged a late return fee. You return the truck to where you rented it, unless a different drop-off location is specified in the rental agreement. IF YOU FAIL TO RETURN THE TRUCK TO THE PROPER RETURN LOCATION, YOU WILL PAY A FEE AND ACKNOWLEDGE THAT YOUR RENTAL FEES MAY BE CHARGED AND UNDERSTAND THAT YOUR RENTAL FEE MAY CHANGE. If the Rental Agreement does not indicate an expiration date and time, you will return the Truck at our request or three (3) days after renting the Truck, whichever occurs first.IF THE VAN IS NOT RETURNED BY THE DUE DATE STATED AT THE TIME OF THE RENTAL DOCUMENT, YOU WILL PAY A LATE FEE AND ACKNOWLEDGE THAT THE RENTAL PRICE MAY CHANGE. A SERVICE FEE OF $25.00 OR MORE MAY APPLY IF THE TRUCK IS NOT RETURNED CLEAN OR ACCESSORIES ARE NOT RETURNED IN THE SAME CONDITION IN WHICH THEY WERE RETURNED. IF YOU RETURN A TRUCK WHEN A LOCATION IS CLOSED, YOU MUST USE THE BOX TO RETURN THE KEYS AND DEPOSIT THE LEASE. YOU REMAIN RESPONSIBLE FOR THE TRUCK AND FOR ALL CHARGES, LOSSES, AND DAMAGE TO THE TRUCK ARISING PRIOR TO THE OPENING OF THE SITE AND THE TRUCK'S LOCATION ON THE SITE. IF THE KEYS ARE NOT IN THE BOX AND THE TRUCK IS NOT ON SITE, SHE IS IN VIOLATION OF THIS AGREEMENT.
8.RETURN OF TRUCK TO SERVICE:We may, at any time, in our sole discretion, terminate this Agreement and repossess the Truck for the following reasons, without limitation: Whenever we determine that it is being used illegally without prior notice, if it is illegally parked, or the terms of this Agreement (for example, if we learn that the truck was purchased based on false or misleading information, or if you attempt to transfer the truck), or if the truck appears to have been abandoned or Budget Truck Rental is notified that the truck has been towed , seized or damaged in any way, or if the truck is used in a way that could damage our reputation. All costs and expenses we incur if we must repossess the truck, such as fines, towing fees, impound fees, and reasonable attorneys' fees, are your sole responsibility and payable to us. If you do not return the truck within the specified return time or sooner at our request, or if we learn that the truck was purchased based on false or misleading information, we may consider the truck converted or stolen and may that legal action be taken. be taken for return without notice or notice.
9.BREACH OF CONTRACT, HANDLING OF ASSETS AND RELATED COSTS:If you fail to perform any of your obligations under this Agreement, in addition to our damages, we are entitled to reasonable costs and expenses, a reasonable administrative fee, and attorneys' fees to enforce this Agreement. If we repossess the truck, we have a lien on all of your belongings in the truck or the equipment installed on the truck. This lien applies to all unpaid fees and expenses owed to us under this Agreement. You grant us a lien on all such assets to secure payment of all such fees and expenses. A copy of this Agreement may be submitted as a Financing Statement to complete this guarantee. We are also authorized to act as your agent for unloading, inventorying and storing such third party goods and payments. We are entitled to reimbursement of our reasonable costs in connection therewith. If you do not pay all fees and expenses owed to us under this Agreement, or after paying, you do not recover your property, we (or our agents) may act as your agent and/or the property at our sole discretion or donate it. . We are not required to notify you prior to such disposition or deletion. Acting in the same manner as your agent and without prior notice, we may dispose and/or donate any other property that you or someone related to you leaves on our premises or in the truck that you or they do not leave within thirty (30) ) days from the date of abandonment or salvage of the truck.
10RENTAL RATES AND CHARGES:
A.You agree to pay all fees, including rental fees, expense reimbursement fees, airport facility fees and/or concession reimbursement fees, energy recovery fees, surcharges, miscellaneous fees, applicable taxes and any other amounts owed to us under this Agreement, for any payment acceptable to us. You will pay for any changes when you return the truck, except for fees determined by us later, which you will pay upon request. We may apply the deposit you left at the time of rental against the charges. If you provide a credit card as payment at the time of rental, we may place a hold with your card issuer at the time of rental based on our estimate of your charges. We may charge such credit card for any amounts owed to us, including, without limitation, amounts in excess of the minimum rental rates agreed to in this Agreement, including fees due when returning the truck. Any payment by credit card is subject to the terms of the cardholder's agreement with the card issuer. If we allow you to pay by check, you agree to pay us a fee for each check used for payment if any fees are returned to us cashless and unpaid, and if any bank charges billed to us are incurred in connection with the returned check. We are not required to present checks for payment more than once. You pay the full price for all or part of the rental day or time, as shown on the Rental Agreement. The price listed on the rental documents is the minimum price, even if the truck is returned early, and starts from the hour and minute the rental starts. You agree that you will not be entitled to a refund if you use fewer days and/or miles. All fees are subject to final review by us. If our review reveals a lower or higher charge, you pay us the difference due for any lower charge; and we will reimburse you for any additional costs.
B.If you do not pay all amounts due to us under this Agreement when due, including, but not limited to, payments for loss of or damage to the Truck, you agree to a late fee of 1 1/2% per month or the higher rate allowed by regulatory payment, whichever is less, on any past due balance. You will bear all costs we incur in collecting such balance, including, but not limited to, administrative fees, collection costs, court costs, and reasonable attorneys' fees. Where permitted by law, we may contact you or your employer at your place of employment regarding payment. You agree that we or our billing agent may use the address you provide on the Rental Agreement as a location to send reminders or reminders.
11MAINTENANCE AND INSPECTION:You agree to maintain a proper level of oil and coolant in the engine. If we direct you to do so, you will perform any necessary service or maintenance on the truck during the rental. No one but us will perform any maintenance, repair, replacement or replacement of parts or maintenance on the truck during the rental, unless we authorize such work in advance. You understand that we, or someone authorized by us, may inspect the truck at any time and without prior notice, regardless of where it is located. You will stop using the truck and contact us before proceeding if a warning light comes on or there is an obvious mechanical problem such as B. Engine bay, puncture, brake problems (scratches, squeals, low pedal pressure) , lighting malfunction, puddles of fluid under the vehicle when parked (except air conditioning condensation), or low power.
12Fines, costs, expenses and administration:COMPLIANCE, TAXES, FEES, PERMITS, FINES AND FINES: YOU WILL COMPLY WITH ALL LAWS APPLICABLE TO YOUR USE OF THE TRUCK, INCLUDING STOPPING AT OPEN WEIGH STATIONS AS REQUIRED OR SPECIFIED, OR FAILING TO USE RESTRICTED LANES OR ROADS. You agree to pay all taxes, special licenses, permits, fines, penalties, and court costs for parking, traffic, tolls, and other violations, including liens and storage fees. A.MAUT/PLATEPASS®:
You are responsible for paying all tolls incurred during the rental period. Budget Truck, through our partner PlatePass, offers an optional service that allows customers to use electronic toll lanes on highways, bridges, tunnels and other toll crossings. All Budget Trucks plates are provided to PlatePass as our third party to process tolls electronically. Unless you pay the toll directly yourself as described below (see "E-Toll Opt-Out"), you are automatically enrolled in the PlatePass Service and pay the fees described herein, the cost of which is detailed in the Toll Agreement. lease you signed. If you use the PlatePass service at any time during your rental, you agree to pay a convenience fee for each toll day, the maximum amount per rental period (not to exceed 30 days). Toll Administrator: When you use the PlatePass service, Budget Truck's designated third-party administrator of the PlatePass toll program (the "Toll Administrator") will process payment of any electronic tolls incurred during the rental period and will charge your credit card / debit for the above. mentioned toll and convenience fees. Regardless of the service you choose, you agree that in connection with e-Toll, we may share your personal information (including your address, credit/debit card details and other rental information) with the Toll Administrator. You also authorize the Toll Administrator and Budget Truck to charge your credit/debit card for all electronic toll fees described above, depending on the option you choose. You agree that the toll administrator may contact you directly regarding electronic toll charges. It may take 4-8 weeks from the end of the rental for electronic toll fees to be charged to your credit/debit card on file. You agree to indemnify and hold us, the toll operator, and any other agent authorized by us harmless from any fines, fees, or administrative charges incurred for toll violations for which you may be liable. The e-Toll is not valid for airport parking. Customers must use a personal transponder or other approved payment method to pay for parking.
Toll violators will incur an administrative fee not to exceed $50 per toll issuer.
YOU MAY AVOID THE CONVENIENCE CHARGE AND ALL OTHER TOLLS BY PAYING TOLLS IN CASH, BY USING YOUR OWN ELECTRONIC TOLL DEVICE, OR BY AVOIDING NON-CASH ROADS OR TOLL PASSES.
You authorize us to share the rental and credit/debit card information related to your rental with ATS Processing Services, LLC and its affiliates (ATS), as our agent, to process and collect toll fees and toll violations from you. tolls incurred or collected by you. against us or against the vehicle during your rental. You authorize ATS as our agent to charge the credit/debit card used to rent the vehicle or you will be charged if no card is registered. You authorize ATS to contact you directly regarding all tolls, toll violations, fines, citations, fines, and penalties incurred or imposed on us or our Vehicle while the Vehicle is rented to you. In the event that we use a third-party collection and/or administration agent, you agree to pay all collection costs and fees, including, without limitation, legal and administrative fees, to such agent upon request and without objection. You agree to indemnify and hold us and ATS harmless from and against all tolls, fines, citations, penalties, and administrative charges.
Video disc-based electronic toll collection
If you do not pay the toll in cash at a toll booth designated by the issuing entity, or if the highway does not accept cash payment, after passing an electronic toll on the network, a photo of the license plate is automatically taken and you realize registration in the PlatePass® toll service.
Transponder-based tolling
If your truck is equipped with an electronic toll collection device (transponder) that works with the road you are traveling on and you wish to use PlatePass® toll service, open the transponder box on the windshield and drive the specified transponder range . If there is a transponder box and you do not want to use the toll service, please do not open the transponder box.

13OPTIONAL DAMAGES:Optional Physical Damage Waiver ("PDW"), Limited Damage Waiver ("LDW") or Commercial Damage Waiver ("CDW") (CDW available for business accounts only) is not insurance and is not required. EXCEPT FOR DAMAGE RESULTING FROM TIRE FLOATING OR IF THE TRUCK IS INVOLVED IN A COLLISION WITH A TALL OBJECT SUCH AS A TREE, OVERPASS, AIR WIRING OR GARAGE STRUCTURE, if you are a PDW, LDW or accept CDW, pay the PDW, LDW or CDW charge for each rental day in whole or in part and the truck is operated in accordance with this agreement, your liability to us for loss of or damage to the truck will be released or limited to the extent specified as your "liability" for the truck will be released or limited to the extent specified as your "liability" in the Rental Agreement. 14LOSS/DAMAGE TO TRUCK:Unless you accept PDW, LDW, or CDW at the time of rental and pay the PDW, LDW, or CDW fee, you will be responsible for, and pay us for, any loss or damage to the truck, whether from fault of any kind or otherwise. This includes, but is not limited to, loss or damage caused by collision, accident, theft, vandalism, fire, flood, explosion, natural or unknown causes. You are also responsible for and will pay us as part of our loss for: Any depreciation on the truck that remains after the repair; actual towing, storage, impound and other related fees; plus our loss of use based on reasonable downtime and a reasonable administrative fee for expenses related to processing the claim. YOU UNDERSTAND THAT YOU WILL ALSO BE LIABLE FOR ANY MECHANICAL DAMAGE TO THE TRUCK RESULTING FROM YOUR BREACH OF THIS AGREEMENT, SUCH AS POOR FUEL, OVERLOADING, OR FAILURE TO HAVE THE SERVICES WE SPECIFIED.You understand that the charges for physical damage to the truck are those specified in our current counter table, are based on our actual repair experience. you even more We understand that these charges may be more or less than our actual cost of Parts, labor or outside repairs.If the truck is stolen or damaged enough for us to declare a total loss, you will be liable for and pay us our book value or actual replacement value of the truck before loss, less its salvage value, whichever is greater. . 15.LIABILITY FOR MOVABLE PROPERTY AND CARGO:UNLESS I AGREE TO THE OPTIONAL PERSONAL AND CARGO PROTECTION AT THE TIME OF RENTAL AS SET FORTH IN SECTION 20, WHICH IS ONLY AVAILABLE TO ME IF I AM A NON-COMMERCIAL CUSTOMER USING THE VAN FOR NON-COMMERCIAL PURPOSES AND PAYING THE FEE WITH IT PROTECTION, I AGREE THAT YOU HAVE NO LIABILITY FOR ANY LOSS OF OR DAMAGE TO MY CARGO OR OTHER PROPERTY OWNED BY ME, EXCEPT FOR LOSS OF MY PROPERTY OR DAMAGE TO MY CARGO OR OTHER PROPERTY OWNED OR IN MY POSSESSION, EXCEPT FOR LOSS OR THE DAMAGE RESULTS SOLELY FROM YOUR INTENTIONAL FAULT. I ASSUME ALL RISK OF LOSS OR DAMAGE AND AGREE TO INDEMNIFY, INDEMNIFY AND HOLD YOU FROM ANY CLAIM, DAMAGE OR LOSS RESULTING FROM SUCH LOSS OR DAMAGE.
sixteen.LIABILITY COVERAGE, ADDITIONAL LIABILITY AND DAMAGE INSURANCE:
A.If the Truck is rented for personal use and there is no violation of the Prohibited Use (Section 4) of this Agreement, we offer limited liability protection for personal injury (including death) and property damage to persons other than those excluded below . arising out of the use or operation of the truck by you or any other authorized driver, up to the minimum limits of financial responsibility required by the financial responsibility laws applicable to truck owners in the jurisdiction in which the accident occurs. The limit for personal injuries sustained by a person includes any claim for loss of that person's trust or services. When the law extends protection to an unauthorized driver, the same limits apply. This protection meets the requirements of the financial responsibility laws of the jurisdiction in which the accident occurs, applicable to truck owners through insurance, bond, certification or self-insurance or other means, or a combination thereof, at our sole discretion. discretion, including requirements related to notice and cooperation by you or the Driver, all of which are part of this Agreement. To the extent permitted by law, this liability protection is secondary to any applicable insurance available to you or any other driver or passenger in the truck from any other source, whether primary, excess, secondary, or conditional in any way. , therefore such protection only to the extent necessary to meet, cumulatively with all available insurance and/or other available protections, the minimum limits of financial responsibility and/or minimum no-fault benefits required by applicable law. You understand that this protection does not include coverage for the following, except to the extent required by applicable law: i) fines, penalties, punitive damages, or exemplary damages, ii) personal injury or death to you or the truck driver or any of Your Family or relatives of the driver, blood, married or adopted who live with you or the driver or with another person who lives with you or the driver or occupant of the truck; iii) defense against claims after the applicable limits of this protection have been set; and iv) non-mandatory, uninsured or underinsured driver or truck insurance, supplemental no-fault insurance, or any other insurance that is optional or may be waived or declined. We and you agree that we waive any disclaimer or disclaimer to the fullest extent permitted by law. You and we agree that, to the fullest extent permitted by law, we waive and reject all non-mandatory insurance that is optional or that can be waived or rejected. B.If the truck is used for commercial (not private) purposes, you must select one of the third party liability insurance policies or provide a certificate of insurance as set out in paragraph 17 below.
C.CIVIL LIABILITY INSURANCE (BLI):When Budget Truck Rental, LLC is added to the lease, it extends your coverage to take the prime position up to 100/300/25. Your own liability insurance will only be used to quote when the 100/300/25 have been used up. This coverage extension includes $10,000 for personal injury (maximum one person) or $300,000 for personal injury (maximum for all parties) and $25,000 for property damage (other vehicle, utility pole, railing, etc.).
D.If you purchase Supplemental Liability Insurance ("SLI") at the beginning of your rental and pay the SLI rate specified in the rental agreement, the higher SLI limits of liability will apply to your rental. F.Subject to applicable law, protection under Sections 16A, 16B, 16C or 16D does NOT apply: (i) if the Truck is purchased, used or operated in violation of Section 4; (ii) for loss of or damage to property belonging to you, on the truck or for any reason under your care, custody or control, and (iii) to a tow truck, auto transporter or trailer not rented or coupled by us on the truck .
17INSURED CLIENT COMPANY ACCOUNT INSURED:
A.If you are a business customer, you may choose to purchase liability insurance instead of purchasing our liability insurance and damage waivers. By proceeding as set forth in the rental agreement, you agree to insure the truck under the standard form of public liability insurance which designates Budget Truck Rental, LLC and Budget Rent A Car System, Inc. as additional insured and all risks are covered loss or damage to persons or property arising from the possession, maintenance, use or operation of the truck during the rental, regardless of fault. The limits of this insurance are not less than a combined individual limit of $750,000 for all bodily injury and property damage resulting from one accident, or higher limits as we may require. You agree to provide us with a certificate of insurance showing required coverage and limitations of liability prior to using the truck. You agree that optional SLI is not available to you once you have chosen to purchase your own liability insurance.
B.You agree to indemnify, hold us harmless, and hold us and our insurers harmless from any costs (including attorneys' fees and court costs), damages, and/or liability arising out of your possession, use, or operation of the Truck (i) exceed the liability limits under your liability insurance, (ii) are excluded from coverage under your liability insurance, or (iii) are not covered by your liability insurance. If applicable state law requires us to extend liability insurance coverage, regardless of your election to provide such liability insurance, you agree that such liability coverage provided by us will be limited as provided in Section 16A. You acknowledge that the rental price provided to you is in part a function of your provision of such full coverage and indemnity insurance by us.
18IDENTIFICATION AND WAIVER:You will defend, indemnify, and hold us, our parent company, and affiliates harmless from and against any and all losses, liabilities, damages, injuries, demands, demands, awards, costs, attorneys' fees, and other expenses incurred by us in any way arising out of this transaction of rental or use of the industrial truck by you or another person, including claims or liabilities against third parties. 19LIABILITY FOR TOWING EQUIPMENT:YOU UNDERSTAND AND AGREE TO ASSUME ALL RISK IN OPERATING, USING OR OWNING THE TOWING EQUIPMENT AND TO INDEMNIFY ANY CLAIM FOR PERSONAL INJURY, INCLUDING DEATH, TO YOURSELF OR OTHERS, OR FOR DAMAGE TO YOUR PROPERTY OR THE PROPERTY OF OTHERS ARISING OUT OF OR IN CONNECTION WITH YOUR USE, POSSESSION OR OPERATION OF TOWING EQUIPMENT, EXCEPT IF SUCH INJURY, DEATH OR DAMAGE RESULTS FROM OUR FAULT. ANY VEHICLE YOU TOW OR TRANSPORT WITH THE TRAIN EQUIPMENT MUST BE THE VEHICLE IDENTIFIED ON THE RENTAL DOCUMENT AT THE PLACE OF ORIGIN AND MUST NOT CONTAIN PASSENGERS OR CARGO. YOU ARE RESPONSIBLE FOR ALL LOSSES OF OR DAMAGE TO VEHICLES TOWED OR TRANSPORTED. 22OPTIONAL ROAD SAFETY NET™:This OPTIONAL COVERAGE is available at all participating locations.THIS OPTIONAL PROTECTION IS ONLY AVAILABLE TO NON-COMMERCIAL CUSTOMERS USING THE TRUCK FOR NON-COMMERCIAL PURPOSES.If you accept Roadside SafetyNet TM ("SafetyNet") at the beginning of your rental and provided you do not violate the Rental Agreement, you will not be responsible for roadside assistance charges for the following services: roadside assistance, tire replacement, replacement, key replacement, lockout service, jump starting, towing to the nearest authorized repair facility (excluding collision towing), and fuel delivery (up to $10 per fuel delivery). booking conditions
A reservation only guarantees the price after it is confirmed with a credit card deposit and shows customer preferences for pick-up location, drop-off location, rental time, rental date, and equipment type.
The pickup location, drop-off location, rental time and date selected on a reservation are a preference only, and if a selected preference is not available, Budget Truck Rental ("BTR") reserves the right to offer the customer an alternative. .
All equipment selected in a reservation is subject to availability at the time of pickup. If the requested equipment is not available, BTR reserves the right to replace the equipment at no additional cost to the customer.
Rates booked online do not include taxes, fees, surcharges, add-ons, protection packages purchased at time of rental, required refundable security deposit, moving supplies, or other applicable charges. Rates will be provided at the time of pickup.
If a customer needs to cancel or change a reservation in any way, they must contact BTR at least 48 hours prior to the pickup date and time indicated on the thank you page and confirmation email. Customer must contact the BTR pickup location provided on the thank you page and confirmation email or call 1-800-462-8343. If BTR is not notified within this time period, a $75 cancellation fee may be charged to the customer's credit/debit card. Customer will be charged a $75 no-show fee that does not result in an open rental agreement within 24 hours of the suggested pickup time.
The online reservation system allows Budget One-Way customers plenty of time to safely complete their move. Travel time estimates for one-way rentals are estimates only. Mileage and trip duration may vary from budget estimates. Budget allows customers to purchase additional days or miles by contacting their Budget Truck Rental pickup location directly, which is displayed on the thank you page. During normal business hours and prior to pickup, customer may add days at a rate of $70 per day and miles at a rate of $0.70 per mile. If a customer books additional days and/or miles at the time of pickup or after pickup, they will be charged $85 per day for additional days and $0.85 per mile for additional miles. Additional days and prepaid miles are non-refundable, including those purchased but not used.
For local rentals, customers are charged for actual kilometers and days of equipment use.
Online discounts cannot be combined with any other rate, promotion or discount offer.
For one-way rentals, the average deposit is $150. For on-site rentals, the average security deposit is $150 or 1.5 times the total estimated rental cost, whichever is greater, but may be higher in certain metropolitan areas.
If a customer pays for a rental with a credit or debit card, the cardholder must be present with their credit/debit card at the time of rental.
At time of rental, Budget requires two current and valid forms of identification from the person signing the rental agreement. Acceptable forms of identification include: a valid US issued driver's license, state issued ID, passport, social security card, vehicle registrations, phone bill and/or military ID, local photo ID from the work, major credit card, and paycheck or paycheck. Budget also requires all rental drivers to have a valid US driver's license.
Any towing equipment is recommended based on the trailer manufacturer's guidelines and vehicle-specific information provided by the customer. Different vehicles may require different tow bars. Some vehicles may not be suitable for towing and should not be attempted if they exceed the trailer manufacturer's guidelines. Budget is not responsible for any damage incurred while using the towing equipment and does not warrant that such equipment is fit for any purpose. Budget Truck connects the tow bar to the rental vehicle at the time of pickup, but cannot bring the tow vehicle onto the tow bar. This is the customer's responsibility. Budget Truck will provide you with an instruction sheet that explains how to properly drive a vehicle on our towing equipment.
Local rentals returned late are subject to the following fees:
